Terms of Use

These terms apply when you download or use the FitDash app or visit fitdash.app.

Agreement

These Terms of Use ("Terms") are an agreement between you and FitDash LLC, 30 N Gould St, Ste N, Sheridan, WY 82801, USA ("FitDash", "we", "us"). By downloading, installing or using the FitDash app (the "App") or the website fitdash.app (together, the "Service"), you agree to these Terms. If you do not agree, do not use the Service.

Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, a parent or legal guardian must agree to these Terms and supervise your play.

Health and safety

FitDash is a physical game. You jump, squat, lean and run in place while you play. You are responsible for playing safely.

  • Talk to a doctor before you start any new physical activity, especially if you are pregnant, have a heart, lung, joint or other medical condition, or have been told to limit exercise.
  • Clear the area around you of furniture, objects, people and pets. Make sure the floor is not slippery and that you have room to move in every direction.
  • Wear suitable shoes and clothes, warm up first and take breaks. Stop at once if you feel pain, dizziness, shortness of breath or discomfort.
  • Place your iPhone and TV securely so they cannot fall.

The Service is for entertainment. It is not a medical device and does not provide medical, health or fitness advice. Any scores or activity figures are estimates for the game only.

License

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. You may not copy, modify, reverse engineer, resell or distribute the App, except where the law allows it.

Subscriptions and in-app purchases

  • The App may offer optional auto-renewing subscriptions and in-app purchases. Prices and what each one includes are shown in the App before you buy.
  • Payment is charged to your Apple Account when you confirm the purchase. Subscriptions renew automatically at the end of each period unless you turn off auto-renew at least 24 hours before the period ends. Your account is charged for renewal within 24 hours before the end of the current period.
  • You can manage and cancel subscriptions in Settings > [your name] > Subscriptions. Canceling stops future renewals; access continues until the end of the paid period.
  • If a free trial is offered, any unused part of the trial ends when you buy a subscription.
  • Purchases are processed by Apple. Refunds are handled by Apple under its policies at reportaproblem.apple.com.
  • Virtual items and in-game currency have no cash value and cannot be exchanged for money.

Acceptable use

You agree not to: use the Service in breach of any law; cheat, exploit bugs or use automated tools to manipulate scores or leaderboards; interfere with or try to gain unauthorized access to the Service or its systems; or use the Service to harass, harm or impersonate others.

Intellectual property

The Service, including its software, game design, graphics, sounds, text and the FitDash name and logo, is owned by FitDash LLC or its licensors and is protected by intellectual property laws. These Terms do not give you any rights to our trademarks. If you send us feedback, we may use it without any obligation to you.

Privacy

Our Privacy Policy explains how we handle data, including how the camera and body tracking are processed on your device.

Apple terms

These Terms are between you and FitDash LLC only, not Apple Inc. ("Apple"). FitDash LLC, not Apple, is solely responsible for the App and its content. Apple has no obligation to provide maintenance or support for the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price for the App; to the maximum extent permitted by law, Apple has no other warranty obligation for the App. Apple is not responsible for addressing any claims by you or a third party relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, or consumer protection claims. Apple is not responsible for investigating, defending, settling or discharging any third-party claim that the App infringes intellectual property rights. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that body tracking will detect every movement, or that the Service will be uninterrupted or error-free. Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you.

Limitation of liability

To the maximum extent permitted by law, FitDash LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any physical injury or property damage arising from your use of the Service, except where caused by our gross negligence or willful misconduct. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, or US $50. Nothing in these Terms limits liability that cannot be limited by law.

Indemnity

You agree to indemnify and hold harmless FitDash LLC from claims arising out of your breach of these Terms or your misuse of the Service, to the extent permitted by law.

Termination

You may stop using the Service and delete the App at any time. We may suspend or end your access if you break these Terms. Sections that by their nature should survive termination will survive.

Governing law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict of law rules. Courts located in Wyoming have exclusive jurisdiction, unless the consumer protection laws of your country of residence give you the right to bring a claim in your local courts.

Changes

We may update these Terms. We will change the date at the top, and if a change is significant we will tell you in the App or by email. If you keep using the Service after a change takes effect, you accept the new Terms.
